Ensuring Human Dignity Behind Bars

In a landmark ruling, the Supreme Court of India has underscored that the constitutional rights to life and dignity do not cease upon incarceration. A bench comprising Justice Vikram Nath and Justice Sandeep Mehta has mandated that all states and union territories must draft and notify a comprehensive policy within three months to facilitate the early or compassionate release of eligible elderly and critically ill prisoners.

The directive stems from a public interest litigation filed by the National Legal Services Authority, which highlighted the growing number of inmates suffering from terminal illnesses or advanced age who require specialized medical care. The court emphasized that under Articles 14 and 21 of the Constitution, equality and human dignity must be upheld even within prison walls.

Digital Integration and Transparency

To streamline the process, the court has ordered the integration of release applications into the e-Prisons portal. This digital framework will track every stage of an application—from initial filing and medical board evaluations to final decisions by competent authorities. This system is designed to prevent procedural delays and ensure that no application remains pending indefinitely.

The court further instructed that the e-Prisons system must include automated alerts to notify officials of approaching deadlines. Furthermore, the Ministry of Home Affairs and the National Informatics Centre have been tasked with providing the necessary technical infrastructure and training to state authorities to ensure a uniform implementation across the country.

Balancing Justice and Compassion

The court clarified that the new policy does not grant automatic release. Each case will be evaluated based on the prisoner's age, medical condition, nature of the crime, and conduct while in custody. However, the bench stressed that procedural hurdles should not force critically ill individuals to endure inhumane conditions.

States are required to submit an affidavit detailing their compliance and the progress of these policies within six months. The Supreme Court has scheduled the next hearing for January 19, 2027, to review the status of these implementations nationwide.
